The Increasing Importance of China and IPR: Detection, Enforcement and Fact Gathering

As China continues its emergence onto the world IP stage, IP issues in China become more frequent and more complex. How does a U.S. holder of Chinese patent rights go about detecting infringement in China? Can it realistically enforce its patent rights? What options does a U.S. patent holder have when companies in China are exporting infringing goods to the U.S.? What role can products manufactured in China play in U.S. litigation concerning validity? How can one detect prior art products and publications in China? A panel of practitioners from China will provide business owners practical insight on these and other China-related IP issues.

Benjamin Qiu
Associate, Cooley LLP (Shanghai Office)
Benjamin Qiu is an associate in the emerging companies practice group and a member of the Cooley Business department. He joined the Firm in 2012 and is resident in the Shanghai office in China. Prior to joining Cooley, Mr. Qiu was Senior Counsel and Fund Director at Innovation Works, a prominent investment fund and start-up incubator based in Beijing and Shanghai for companies in the mobile computing, e-commerce, and cloud computing sectors. In addition to founding the legal team at Innovation Works, Mr. Qiu supervised the formation of three venture capital funds and the formation of over 50 early-stage technology companies and their subsequent financing rounds. He was instrumental in negotiating financing terms on behalf of Innovation Works and its portfolio companies, and he advised the companies on corporate governance and technology protection and licensing. Mr. Qiu is a frequent speaker at local and international conferences on the subject of venture capital, the start-up company environment, and intellectual property in China. Prior to Innovation Works, Mr. Qiu was an attorney with Lovells LLP (now Hogan Lovells) in Beijing and Shanghai. Prior to Lovells LLP, he clerked at the Beijing No. 2 Intermediate Court in its Intellectual Property Division. Mr. Qiu is a native speaker of Mandarin Chinese. He is a graduate of Santa Clara University Law (2005) and received a BA in Computer Science from Webster University in 2002.
Dr. James J. Zhu

Dr. James Zhu is a partner at Jun He Law Offices responsible for strengthening the firm’s IP practice in China by splitting his time between China and the US. James’ practice includes patent procurement, opinion, analysis & strategy, litigation, technology licensing, primarily focusing on life sciences, material sciences, medical device, and electronics. As a conduit between China and the rest of the world, James represents international clients to obtain and enforce their intellectual property (IP) rights in the fast-evolving and challenging IP environment in China. In particular, James helps international clients to enhance the value of IP assets, lower IP risks, and increase commercialization opportunities through comprehensive due diligence, counseling, procurement, litigation and cross-border licensing and collaboration. Prior to joining Jun He, James worked at Lyon & Lyon and Perkins Coie. James was a partner in Perkins Coie’s Los Angeles Office and the Managing Partner of its Beijing Office. In the late 90s, James was a co-founder & General Counsel of GanTech International, a venture backed start-up in Silicon Valley where he spearheaded fund-raising, legal and business development activities. In the early 90s, James was a research scientist at Merck & Co. James is a member of the State Bar of California and a patent attorney registered to practice before the US Patent & Trademark Office. James graduated from Fudan University, Shanghai. With a total of seven academic years, James earned a Ph.D. degree from the California Institute of Technology and J.D. & MBA dual degrees from Columbia University.
